Please read these Terms and Conditions carefully before purchasing or using The Spanish Program. By registering an account, purchasing a course, or accessing the learning platform, you agree to be bound by these terms.
1. Provider Information
The Spanish Program is operated by Fernando Pérez Cos (NIF: 13774598J), trading as The Spanish Program, with registered address at Barrio Cotillo 4, Aés, 39670 Puente Viesgo, Cantabria, Spain.

2. The Service
The Spanish Program provides online Spanish language courses structured from level A1 to C2 according to the Common European Framework of Reference for Languages (CEFR). Courses are delivered through the Moodle learning platform at learn.thespanishprogram.com and include structured content, written exercises, AI-generated feedback, and instructor supervision.
Levels available at any given time are listed on the Courses page. Levels not yet available may be announced with an expected release date, which is provided as an estimate only.
3. Accounts and Access
On completing a purchase, a Moodle account is automatically created using the email address you provide at checkout. You will receive login credentials by email. You are responsible for keeping your credentials confidential.
Each licence is for a single individual learner. You may not share your account with any other person. We reserve the right to suspend accounts that show evidence of credential sharing.
Your access to a purchased level does not expire, provided your account remains in good standing. Access to bundle purchases grants access to all specified levels simultaneously.
4. Payment
All prices are displayed in Euros (€). Applicable VAT will be added at checkout where required by law. Payment is processed securely by PayPal. We do not store payment card details.
For institutional clients (B2B arrangements with language academies, schools or training providers), separate commercial agreements apply. Contact fernando@thespanishprogram.com for details.
5. Refund Policy
We offer a full refund if both of the following conditions are met:
- The refund request is submitted within 7 days of the date of purchase, and
- You have completed less than 20% of the purchased level or bundle.
To request a refund, email fernando@thespanishprogram.com with your name, email address used at purchase, and order details. Approved refunds are processed within 14 days to the original payment method.
No refund will be issued if more than 7 days have elapsed since purchase, or if 20% or more of the course content has been accessed or completed.
Note for EU consumers: Under EU Directive 2011/83/EU on consumer rights, you have a statutory 14-day right of withdrawal from digital content contracts. However, this right is lost once you have given explicit consent to immediate access to the digital content and acknowledged that your right of withdrawal is thereby lost. By purchasing and accessing course content, you acknowledge this waiver. The 7-day / under-20% policy above is offered as an additional goodwill guarantee.
6. AI-Generated Feedback
Written exercises submitted through the platform are assessed using artificial intelligence (Google Gemini API). AI feedback is provided as an educational tool to support your learning. It does not constitute formal language certification, nor does it guarantee a specific level assessment. All AI feedback is supervised by Fernando Pérez Cos, a qualified Spanish language teacher with over 30 years of experience and an official SIELE examiner.
Response times for AI feedback are typically immediate. Instructor review of flagged or complex cases may take up to 5 working days.
7. Intellectual Property
All course content — including but not limited to text, exercises, audio materials, video content, feedback prompts, graphic design, and the overall course structure and methodology — is the intellectual property of Fernando Pérez Cos / The Spanish Program. All rights reserved.
You are granted a personal, non-transferable, non-exclusive licence to access and use the content for your own private learning purposes only. You may not reproduce, distribute, publish, transmit, modify, translate, adapt, or create derivative works from any course content without our prior written consent.
Your own written submissions (exercise responses, forum posts) remain your property. By submitting them, you grant The Spanish Program a limited, non-exclusive licence to process and store them for the purpose of delivering the service, including the generation of AI feedback.
8. Acceptable Use
You agree not to:
- Share your login credentials or allow any other person to access the platform using your account.
- Download, copy, screenshot, or distribute course materials outside the platform.
- Use automated tools, bots, or scripts to access, extract, or scrape content from the platform.
- Attempt to reverse-engineer, decompile, or circumvent any technical protection measures.
- Submit content that is unlawful, defamatory, abusive, or that infringes the rights of third parties.
Breach of these conditions may result in immediate suspension or termination of your account without refund.
9. Platform Availability
We aim to maintain continuous availability of the learning platform but cannot guarantee uninterrupted access. Scheduled maintenance will be notified in advance where practicable. We are not liable for service interruptions caused by circumstances outside our reasonable control, including hosting provider outages, internet infrastructure failures, or force majeure events.
10. Limitation of Liability
To the fullest extent permitted by applicable law, The Spanish Program shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of, or inability to use, the platform or its content.
Our total aggregate liability for any claim arising out of or in connection with these Terms shall not exceed the total amount you paid for the course or courses giving rise to the claim.
Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, death or personal injury caused by our negligence, or any other matter that cannot be excluded or limited under applicable law.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Spain. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cantabria, Spain, without prejudice to any mandatory rights you may have as a consumer under the law of your country of residence.

12. Changes to These Terms
We reserve the right to update these Terms at any time. The revised version will be published on this page with an updated date. Where changes are material, we will notify registered users by email. Continued use of the service after changes have been posted constitutes acceptance of the revised Terms.
